This website is operated by Wax Melt Boutique. Throughout these Terms of Service, “Wax Melt Boutique,” “we,” “us,” and “our” refer to Wax Melt Boutique.
We operate this website and online store, including its content, features, products, tools, and related services (collectively, the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products to you.
These Terms of Service (“Terms”), together with any policies referenced in them, explain your rights and responsibilities when using the Services. Please read them carefully because they contain important provisions concerning warranties, liability, and dispute resolution.
By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy [INSERT LINK]. If you do not agree, do not access or use the Services.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence. If you allow a minor dependent to use the Services on a device you own or manage, you accept responsibility for that use.
You may be asked to provide information such as your name, email address, billing details, payment information, and shipping address. You agree to provide information that is accurate, current, and complete and to update it when necessary.
You are responsible for protecting your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.
SECTION 2 — PRODUCTS AND HANDCRAFTED VARIATIONS
We make reasonable efforts to display our candles, wax melts, accessories, colors, finishes, and packaging accurately. However, your device settings and screen may affect how colors and product details appear.
Many of our products are handcrafted. Minor variations in color, shape, texture, decoration, fragrance appearance, wax finish, and packaging may occur. These natural variations are not defects and help make each handmade product unique.
Fragrance is subjective, and we cannot guarantee that a scent will meet every customer’s personal preference or smell exactly as anticipated.
Product descriptions, photographs, prices, ingredients, availability, and other information may be changed without notice. We may discontinue products or limit quantities available to a person, household, region, or jurisdiction.
SECTION 3 — PRODUCT USE AND SAFETY
You agree to read and follow all instructions, warning labels, and safety information supplied with our candles, wax melts, wax warmers, and related products.
Candles must never be left burning unattended. Keep burning candles away from children, pets, drafts, flammable materials, and unstable surfaces. Trim and maintain candle wicks as directed and discontinue use when instructed on the product’s safety label.
Wax melts must be used only in an appropriate wax warmer and according to the warmer manufacturer’s instructions. Do not ingest wax or fragrance products, add water to melted wax, or leave a warmer operating unattended.
Our products are intended for home-fragrance use only unless expressly stated otherwise. They are not food, cosmetics, or personal-care products. Wax melts and fragrance items may resemble food or decorative objects and must be kept away from children and pets.
You assume responsibility for using products safely and as instructed. Nothing in these Terms limits liability that cannot legally be excluded.
SECTION 4 — ORDERS AND ACCEPTANCE
Placing an order constitutes an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean that we have accepted it.
We may accept, decline, limit, or cancel an order when reasonably necessary, including because of product availability, suspected fraud, pricing or listing errors, payment problems, shipping restrictions, or suspected unauthorized resale.
Payment must be authorized and processed before an order is accepted. Please review your order carefully before submitting it. Because we may begin processing orders promptly, we cannot guarantee that cancellation or modification requests can be accommodated.
If we change or cancel an order, we will attempt to notify you using the email address, billing information, or telephone number submitted with the order. If payment has already been collected for a canceled item, the applicable amount will be refunded.
Products purchased through our retail store are intended for personal or household use and not for unauthorized commercial resale or export.
SECTION 5 — PRICES, BILLING, AND PAYMENT
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when your order is placed, subject to correction of obvious errors.
Unless expressly stated otherwise, displayed prices do not include shipping, handling, taxes, customs duties, brokerage fees, or import charges. You are responsible for charges associated with delivery to your location unless applicable law provides otherwise.
You agree to provide current, complete, and accurate billing, payment, and account information. You represent that you are authorized to use the selected payment method and agree to pay all charges associated with your order.
Promotions may be governed by separate terms. If promotion terms conflict with these Terms, the specific promotion terms will control for that promotion.
SECTION 6 — SHIPPING AND DELIVERY
Processing and delivery dates are estimates, not guarantees. Delays may occur because of carrier operations, weather, holidays, customs processing, high order volume, supply disruptions, incorrect address information, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate shipping address. Please contact us promptly if you notice an error. We cannot guarantee that an address can be changed after processing begins.
Responsibility for loss or damage during delivery will be determined in accordance with applicable law. Nothing in this section limits rights that cannot legally be waived.

SECTION 7 — RETURNS, FINAL-SALE PRODUCTS, AND REFUNDS
Purchases are subject to our Return and Refund Policy [INSERT LINK], which is incorporated into these Terms.
Candles and wax melts are final sale and cannot be returned or exchanged, except when an item arrives damaged, defective, or incorrect, or when a return is required by applicable law.
Eligible non-candle and non-wax-melt products may be returned in accordance with our Return and Refund Policy. Approved discretionary returns are subject to a 15% restocking fee where permitted by law.
When an eligible return is approved, we will provide a prepaid return shipping label. The cost of that label will be deducted from the customer’s refund. Return shipping and the restocking fee will not be charged when the return is caused by our error, the product is damaged or defective, or applicable law requires otherwise.
Sale items, custom or personalized products, used products, and gift cards are non-returnable except where required by law.
SECTION 8 — INTELLECTUAL PROPERTY
The Services and their content—including our business name, branding, logos, product names, photographs, graphics, text, videos, audio, designs, arrangement, and other materials—are owned by or licensed to Wax Melt Boutique and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, nonexclusive right to access and use the Services for lawful personal, noncommercial purposes.
Without our prior written permission, you may not copy, reproduce, modify, distribute, publish, display, transmit, sell, license, create derivative works from, or commercially exploit any part of the Services.
Wax Melt Boutique’s names, logos, product names, designs, and slogans may be trademarks of Wax Melt Boutique or its licensors. Shopify’s names, logos, and marks belong to Shopify. Other marks appearing through the Services belong to their respective owners.
SECTION 9 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, applications, payment processors, integrations, or other services operated by third parties. We do not necessarily monitor or control these services.
Third-party tools are provided on an “as is” and “as available” basis, subject to the third party’s own terms and policies. Your use of them is at your discretion and risk.
We may introduce new features, tools, or resources in the future. Unless stated otherwise, they will be considered part of the Services and governed by these Terms.
SECTION 10 — THIRD-PARTY LINKS
The Services may contain links to websites, content, or services operated by third parties. We are not responsible for reviewing or guaranteeing the accuracy, safety, availability, or practices of third-party resources.
If you leave our Services to access a third-party website, you do so at your own discretion. Review that third party’s terms and privacy practices before submitting information or completing a transaction.
Questions or complaints concerning third-party products or services should be directed to the applicable third party.
SECTION 11 — OUR RELATIONSHIP WITH SHOPIFY
Wax Melt Boutique is powered by Shopify, which provides the ecommerce platform used to make the Services available.
All purchases from our store are made directly from Wax Melt Boutique. Shopify is not the seller of our products and is not responsible for fulfilling orders or addressing product-related claims.
To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from your purchase or use of products sold by Wax Melt Boutique. This section does not limit any right that cannot legally be waived.
SECTION 12 — PRIVACY
Personal information collected through the Services is handled according to our Privacy Policy.
Because Shopify hosts our store, Shopify may collect and process information relating to your access to and use of the Services. Certain information may also be shared with service providers—including payment, shipping, analytics, and marketing providers—to operate our business and fulfill your order.

You grant Wax Melt Boutique a nonexclusive, worldwide, perpetual, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, distribute, and display that User Content for operating, improving, and promoting the Services.
You represent that your User Content:

Information available through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability.
We may correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted. If we cancel an order after collecting payment, we will refund the applicable amount.

You may stop using the Services at any time.
We may suspend or terminate access to all or part of the Services if you violate these Terms, misuse the Services, engage in suspected fraud, or create a security or legal risk.
Termination does not affect payment obligations or rights and responsibilities that arose before termination. Provisions that should reasonably survive—including those concerning intellectual property, liability, indemnification, governing law, and dispute resolution—will remain effective.
SECTION 17 — DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY STATED BY WAX MELT BOUTIQUE OR REQUIRED BY LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, UNINTERRUPTED, TIMELY, OR ERROR-FREE.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the fullest extent permitted by law.
SECTION 18 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, WAX MELT BOUTIQUE AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, personal injury caused by negligence, violations of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.
SECTION 19 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Wax Melt Boutique and its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable legal expenses arising from:

SECTION 21 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms and the policies referenced in them constitute the entire agreement between you and Wax Melt Boutique regarding use of the Services and supersede prior communications concerning the same subject.
SECTION 22 — ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms as part of a merger, acquisition, sale, reorganization, or other transfer of our business, subject to applicable law.
SECTION 23 — GOVERNING LAW
These Terms are governed by the laws of North Carolina, USA, without regard to conflict-of-law principles.
Any dispute that may lawfully be subject to an exclusive forum will be heard in the appropriate courts located in [COUNTY/CITY, STATE/PROVINCE AND COUNTRY].
Nothing in this section deprives a consumer of mandatory protections or rights available under the laws of the consumer’s place of residence.
